Brian Nelson is a highly experienced Mediator who has mediated over 1500 cases during his tenure as a Staff Mediator with the United States Equal Employment Opportunity Commission (EEOC). He had an outstanding documented successful resolution rate of over 80% while with the EEOC. After 32 plus years of experience with the U.S. Government, of which 28 of those years were with the EEOC, he retired at the end of 2017 in order to begin his independent mediation practice, Brian Nelson Mediation, LLC.
Brian has extensive experience in the areas of labor and employment, with a special emphasis on employment discrimination. He has mediated a wide variety of charges including, but not limited to, race and color discrimination (including racial harassment), sex discrimination (including pregnancy discrimination, sexual harassment, equal pay, sexual orientation and gender identity or expression), age discrimination, religious discrimination (including religious accommodation and dress and grooming policies), disability discrimination (including reasonable accommodation and undue hardship), national origin discrimination (including citizenship and immigration issues and English-only policies), genetic discrimination, and retaliation and harassment under various statutes. Although the EEOC does not cover certain forms of workplace issues such as wage and hour violations, FMLA, wrongful termination, ERISA or OSHA, these issues often arose during his mediations and Brian used his expertise to help the parties resolve these issues through global settlements between the parties.
